लखनऊ विकास प्राधिकरण (एलडीए) की पारदर्शिता और जवाबदेही पर एक बार फिर सवालिया निशान लग गया है। हाल ही में एलडीए उपाध्यक्ष प्रमथेश कुमार के पत्र, सामाजिक कार्यकर्ता और आरटीआई एक्टिविस्ट उर्वशी शर्मा द्वारा दाखिल आरटीआई आवेदन और एलडीए द्वारा दिए गए जवाब से यह साफ़ दिखता है कि प्राधिकरण एक ही जानकारी को मीडिया को तो लगातार साझा कर रहा है, लेकिन वही सूचना आरटीआई के तहत आम नागरिकों और सामाजिक कार्यकर्ताओं को देने से इनकार कर रहा हैl

 

सूचना देने में दोहरा मापदंड

31 मई 2025 को एलडीए उपाध्यक्ष प्रमथेश कुमार द्वारा जारी पत्र में स्पष्ट रूप से उल्लेख है कि अवैध निर्माणों और शिकायतों को लेकर हिंदुस्तान जैसे अखबारों में खबरें प्रकाशित हुई हैं। पत्र में यह भी स्वीकार किया गया है कि कई शिकायतकर्ता अवैध निर्माणों से जुड़े हैं और गलत शिकायतें कर जनता का शोषण कर रहे हैं। लेकिन जब सामाजिक कार्यकर्ता उर्वशी शर्मा ने इन्हीं मामलों से जुड़ी विस्तृत जानकारी आरटीआई के तहत मांगी, तो एलडीए ने सूचना देने से मना कर दिया और RTI अधिनियम की धारा 8(1)(j) का हवाला दिया। एलडीए का तर्क है कि यह 'व्यक्तिगत सूचना' है, जबकि वही तथ्य मीडिया को लगातार उपलब्ध कराए जा रहे हैं।

 

मीडिया और अवैध  निर्माण माफिया से मिलीभगत के आरोप

एलडीए की यह कार्यशैली इस ओर इशारा करती है कि प्राधिकरण कुछ चुनिंदा मीडिया हाउस और पत्रकारों के साथ मिलकर अवैध निर्माण सिंडिकेट को संरक्षण दे रहा है। कई बार देखा गया है कि अवैध निर्माण, फर्जी प्लॉट बिक्री और सरकारी जमीनों पर कब्ज़े के मामलों में मीडिया के कुछ हिस्से और एलडीए अधिकारी एक-दूसरे के हित साधने में लगे हैं। हाल ही में गोमती नगर में फर्जी दस्तावेज़ों के जरिए 39 प्लॉट बेचे जाने का मामला सामने आया, जिसमें एलडीए के अंदरूनी लोगों की मिलीभगत उजागर हुई।

 

हाईकोर्ट ने भी हाल के आदेशों में यह पाया है कि लाभ के लिए बिल्डर, अधिकारी और मीडिया के कुछ लोग मिलकर अवैध निर्माण को बढ़ावा दे रहे हैं और आम जनता के हितों की अनदेखी कर रहे हैं। कोर्ट ने यह भी कहा कि जब तक अधिकारियों पर वित्तीय और कानूनी जिम्मेदारी तय नहीं होगी, तब तक यह प्रवृत्ति नहीं रुकेगी।

आरटीआई कानून का उल्लंघन और संभावित कानूनी कार्रवाई

आरटीआई कानून के तहत यदि कोई सूचना सार्वजनिक हित में है और वही जानकारी मीडिया को दी जा रही है, तो उसे आरटीआई आवेदक को न देना कानून का उल्लंघन है। विशेषज्ञों के अनुसार, इस मामले में सूचना आयोग या उच्च न्यायालय में याचिका दायर कर एलडीए की कार्यशैली को चुनौती दी जा सकती है। साथ ही, भ्रष्टाचार निवारण अधिनियम के तहत भी जांच और कार्रवाई की मांग उठ सकती है।

प्रमथेश कुमार और एलडीए की भूमिका संदिग्ध

एलडीए उपाध्यक्ष प्रमथेश कुमार की भूमिका भी सवालों के घेरे में है। हाल ही में राज्य सरकार ने भ्रष्टाचार के मामलों में कई वरिष्ठ अधिकारियों पर कार्रवाई की है। ऐसे में एलडीए और उसके अधिकारियों के खिलाफ भी स्वतंत्र जांच और जवाबदेही तय करने की मांग उठ रही है।

जनता और सामाजिक कार्यकर्ताओं की मांग

• एलडीए द्वारा मीडिया को दी गई समस्त सूचनाएं सार्वजनिक की जाएं।
• आरटीआई आवेदनों पर पारदर्शिता बरती जाए और मनमाने ढंग से सूचना रोकी न जाए।
• अवैध निर्माण, फर्जी प्लॉट बिक्री और मीडिया-सिंडिकेट के गठजोड़ की उच्चस्तरीय जांच कर दोषियों पर कार्रवाई हो।
• एलडीए के कार्यों की न्यायिक निगरानी में जांच कराई जाए।

निष्कर्ष

लखनऊ विकास प्राधिकरण की कार्यशैली और उसके अधिकारियों की भूमिका पर गंभीर सवाल उठ रहे हैं। जब एक ही सूचना मीडिया को दी जा सकती है, तो उसे आरटीआई के तहत आम नागरिकों से छुपाना न केवल कानून का उल्लंघन है, बल्कि यह भ्रष्टाचार और मिलीभगत की ओर भी इशारा करता है। अब देखना यह है कि सरकार और प्रशासन इन आरोपों पर क्या ठोस कदम उठाते हैं, या फिर यह सिलसिला यूं ही चलता रहेगा।

Discrepancy in Information Sharing

In a letter dated 31 May 2025, LDA Vice Chairman Prathamesh Kumar acknowledged the ongoing issue of illegal constructions in Lucknow and highlighted the exploitation of the public by certain individuals through the misuse of complaints. The letter also referenced news reports published by prominent newspapers, including Hindustan, which detailed the LDA’s actions and findings regarding illegal constructions and related complaints.

However, when Urvashi Sharma filed an RTI seeking detailed information on these complaints and LDA’s actions, her request was rejected under Section 8(1)(j) of the RTI Act, citing privacy concerns and lack of public interest23. The rejection stands in stark contrast to the LDA’s willingness to share similar information with media outlets, as documented in its own correspondence and media coverage.

Allegations of Collusion

This selective approach to information dissemination raises concerns about the LDA’s motives and its relationship with certain media houses and personnel. Critics allege that the LDA, under Prathamesh Kumar’s leadership, is working in tandem with a group of corrupt media professionals and an illegal construction syndicate. The pattern suggests that information is being strategically leaked to media houses that are complicit in shielding or promoting the interests of the illegal construction lobby, while genuine activists and the public are denied access to the same information under the pretext of privacy.

Such practices not only undermine the spirit of the Right to Information Act but also raise questions about the LDA’s accountability and its role in perpetuating a nexus between corrupt officials, media, and illegal builders.

Potential Legal and Civil Actions

Legal experts point out that denial of information under RTI, especially when the same information is being shared with the media, could be challenged before the State Information Commission. Activists may also pursue writ petitions in the High Court, alleging violation of the RTI Act and seeking an investigation into the LDA’s collusion with corrupt media personnel and illegal construction syndicates. Civil society groups are demanding a probe by anti-corruption agencies and stricter action against officials and media houses found complicit in such activities.

Public Interest at Stake

The ongoing controversy highlights the urgent need for greater transparency and accountability in urban governance. As the LDA continues to face allegations of shielding vested interests, the demand for a thorough investigation into its practices and its relationship with the media and construction syndicates is growing louder.
