लखनऊ / बुधवार,10 जून 2026........................ उत्तर प्रदेश राज्य मानवाधिकार आयोग ने सामाजिक कार्यकर्ता एवं आरटीआई एक्टिविस्ट उर्वशी शर्मा द्वारा दायर एक गंभीर शिकायत पर संज्ञान लेते हुए टुंडे कबाबी समूह से जुड़े मो. उसमान, मो. सलमान, तौसीफ जहां एवं अन्य के विरुद्ध लगाए गए आरोपों की जांच के लिए प्रकरण पुलिस कमिश्नर, लखनऊ को भेज दिया है। आयोग ने पुलिस कमिश्नर को निर्देश दिया है कि शिकायतकर्ता को जांच प्रक्रिया में शामिल करते हुए छह सप्ताह के भीतर उचित कार्रवाई कर रिपोर्ट उपलब्ध कराई जाए।

 

शिकायत में आरोप लगाया गया है कि टुंडे कबाबी के विभिन्न प्रतिष्ठानों पर खाद्य सुरक्षा, भवन सुरक्षा, अग्नि सुरक्षा एवं सार्वजनिक सुरक्षा संबंधी सरकारी नियमों का कथित रूप से उल्लंघन किया गया, जिससे आम नागरिकों के जीवन, स्वास्थ्य और सुरक्षा को गंभीर खतरा उत्पन्न हुआ। शिकायत में कहा गया कि इन प्रतिष्ठानों में अत्यधिक भीड़, अव्यवस्थित संचालन, अपर्याप्त आपदा प्रबंधन व्यवस्था तथा आग अथवा भगदड़ जैसी दुर्घटनाओं का स्थायी जोखिम बना रहा, जिससे आसपास के निवासियों और ग्राहकों को निरंतर असुविधा और खतरे का सामना करना पड़ा।

 

शिकायत के अनुसार, लखनऊ विकास प्राधिकरण (एलडीए), खाद्य सुरक्षा एवं औषधि प्रशासन तथा अग्निशमन विभाग की विभिन्न जांचों में कई गंभीर कमियां और अनियमितताएं सामने आई थीं। कुछ भवनों को संरचनात्मक दृष्टि से असुरक्षित बताया गया जबकि कुछ प्रतिष्ठानों में अग्नि सुरक्षा मानकों के उल्लंघन की बात भी जांच में सामने आई।

 

उर्वशी शर्मा ने आयोग को बताया कि सार्वजनिक हित में की गई शिकायतों के बाद संबंधित प्रतिष्ठानों के विरुद्ध विभागीय कार्रवाई प्रारंभ हुई। बाद में खाद्य सुरक्षा विभाग की जांच रिपोर्ट में भी शिकायतों को सही पाए जाने तथा अभियोजन की कार्यवाही प्रारंभ किए जाने का उल्लेख किया गया।

 

शिकायत में यह भी कहा गया कि इन कथित कृत्यों से भारतीय नागरिकों के सुरक्षित भोजन, सुरक्षित सार्वजनिक स्थलों, स्वास्थ्य, जीवन तथा स्वच्छ एवं सुरक्षित वातावरण के अधिकार प्रभावित हुए। शिकायतकर्ता ने इन गतिविधियों को केवल प्रशासनिक अनियमितता नहीं बल्कि व्यापक जनहित और मानवाधिकारों पर प्रतिकूल प्रभाव डालने वाला मामला बताया।

 

सार्वजनिक उपद्रव और BNSS के तहत कार्रवाई की मांग

याचिका में यह भी मांग की गई कि मामले की जांच सार्वजनिक उपद्रव (Public Nuisance) और लोक सुरक्षा के दृष्टिकोण से की जाए। शिकायतकर्ता का कहना है कि यदि किसी प्रतिष्ठान के संचालन से बड़ी संख्या में लोगों की सुरक्षा, स्वास्थ्य अथवा सुविधा प्रभावित होती है तो सक्षम कार्यपालिक मजिस्ट्रेट भारतीय नागरिक सुरक्षा संहिता, 2023 (BNSS) की सार्वजनिक उपद्रव निवारण संबंधी धाराओं के अंतर्गत हस्तक्षेप कर सकते हैं। शिकायत में ऐसे प्रतिष्ठानों के विरुद्ध आवश्यक होने पर संचालन प्रतिबंध, सुधारात्मक आदेश अथवा अन्य वैधानिक कार्रवाई किए जाने की भी मांग की गई।

 

"भ्रष्ट महिला" कहे जाने का आरोप

मामले का दूसरा महत्वपूर्ण पहलू शिकायतकर्ता के विरुद्ध कथित अपमानजनक टिप्पणी से जुड़ा है। शिकायत में आरोप लगाया गया कि 12 फरवरी 2026 को मो. उसमान द्वारा प्रसारित एक पत्र में उर्वशी शर्मा को बिना किसी प्रमाण के "भ्रष्ट महिला" बताया गया। शिकायतकर्ता ने इसे महिला सम्मान, प्रतिष्ठा और गरिमा पर सीधा हमला बताते हुए मानसिक उत्पीड़न और सामाजिक मानहानि का मामला बताया।

 

आयोग ने पुलिस जांच के दिए निर्देश

मानवाधिकार आयोग ने मामले को "Indignity of Women" (महिला की गरिमा का हनन) श्रेणी में दर्ज करते हुए शिकायत का अवलोकन किया और पुलिस कमिश्नर, लखनऊ को उचित कार्रवाई करने के निर्देश दिए। आयोग ने स्पष्ट किया कि शिकायतकर्ता को जांच प्रक्रिया में शामिल किया जाए तथा छह सप्ताह के भीतर की गई कार्रवाई से अवगत कराया जाए।

 

मामले ने लखनऊ में सार्वजनिक सुरक्षा, व्यावसायिक प्रतिष्ठानों के नियमन, महिला शिकायतकर्ताओं की सुरक्षा तथा सार्वजनिक हित में शिकायत करने वालों के अधिकारों को लेकर एक नई बहस छेड़ दी है। अब निगाहें पुलिस कमिश्नर कार्यालय की जांच और आगामी कार्रवाई पर टिकी हैं।

The Uttar Pradesh State Human Rights Commission (UPSHRC) has directed the Police Commissioner, Lucknow, to examine serious allegations against individuals associated with the Tunday Kababi restaurant chain, including Mohd. Usman, Mohd. Salman and Tausif Jahan, following a complaint filed by social worker and RTI activist Urvashi Sharma.

 

In an order passed on 28 April 2026, the Commission forwarded the complaint to the Police Commissioner for appropriate action and directed that the complainant be associated with the inquiry process. The Commission further instructed that action taken in the matter be communicated within six weeks.

 

The complaint alleged that several Tunday Kababi establishments in Lucknow were operating in violation of multiple government norms relating to food safety, building safety, fire safety and public safety, thereby creating a serious threat to public life and health.

 

The establishments named in the complaint include outlets located at Aliganj, Aminabad, Hardoi Road, Lulu Mall and Hussainabad. According to the petitioner, departmental inspections and inquiries conducted by various authorities had reportedly identified significant deficiencies at different locations, including food safety violations, structural safety concerns, fire safety shortcomings and inadequate crowd-management measures.

 

The complaint further alleged that the continued operation of such establishments despite identified deficiencies amounted to a public nuisance affecting nearby residents and visitors. It was contended that excessive overcrowding, inadequate emergency preparedness and potential risks of fire, stampede and other accidents endangered the lives of customers and the general public.

 

The petitioner also urged authorities to examine the matter from the perspective of public nuisance and public safety provisions under the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, arguing that where commercial activities create hazards, obstruction or danger to the public, preventive and remedial action may be warranted under the law.

 

Apart from the public safety concerns, the complaint raised allegations of harassment and violation of women's dignity. Urvashi Sharma alleged that after she pursued public-interest complaints against the establishments, Mohd. Usman circulated a communication on 12 February 2026 allegedly describing her as a “corrupt lady” without any supporting evidence.

 

 

According to the complaint, the statement was intended to undermine her credibility, damage her reputation and discourage her from pursuing public-interest grievances. The petitioner characterized the remark as an attack on her dignity, honour and rights as a woman citizen.

 

 

Significantly, the complaint stated that a subsequent inquiry conducted by another Food Safety Department officer reportedly found the substantive allegations raised by the complainant to be correct and indicated that prosecution proceedings against the concerned establishments were under process. The petitioner argued that this development demonstrated that the remarks directed against her were retaliatory and malicious.

 

Before the Human Rights Commission, the complainant sought an independent inquiry into the alleged violations, action against those responsible for endangering public safety, examination of the alleged insult to her dignity as a woman, accountability of public officials involved, compensation for mental harassment and issuance of guidelines to protect women complainants from victimisation.

 

The Commission registered the matter under the category of “Indignity of Women” and, after examining the complaint, transmitted it to the Police Commissioner, Lucknow, for appropriate action.

 

The case is expected to draw attention to issues concerning public safety compliance at commercial establishments, accountability of regulatory authorities, protection of women complainants, and the rights of citizens who raise matters of public interest.
